Gambling Act - Premises -
Summary
The Licensing Authority is responsible for licensing premises that offer facilities for gambling. These gambling facilities are broken down into 6 premises licence types:
a) Casino premises (converted, large and small);
b) Bingo Premises;
c) Betting track premises;
d) Betting Other (Betting Shops);
e) Adult Gaming Centres; and
f) Family Entertainment Centres.
The Gambling Commission was set up under the Gambling Act 2005 to regulate commercial gambling in Great Britain. It is an independent non-department public body who are sponsored by the Department for Culture Media and Sport (DCMS). The Commission is responsible for issuing operating licences and personal licences and for enforcing the regulations surrounding the use of such licences. They are also responsible for providing advice and guidance to the trade, local authorities and the Government on commercial gambling.

Relevant legislation
To apply for a premises licence you must:
• be 18 years old or older;
• if applying on behalf of a company or partnership be authorised to make such an application; and
• hold or have applied for an Operating Licence from the Gambling Commission for the relevant gambling activity.

As a requirement of the Gambling Act 2005 the Commission must provide Guidance to local authorities. The local authority will consider applications after having regard to this guidance. Applicants should read the relevant parts of the guidance before submitting an application.

Attachments to be submitted with your Application
New applications, provisional statements and variations to change the layout of an existing premises licence must be accompanied by a plan of the premises. -

Declaration
Upon completion of your application you will be required to confirm that you:
a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within;
b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law;
c) declare that the information provided is true to the best of your knowledge and belief;
d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution;
e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation;
f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police; -
Application Evaluation Process
Applications must be made using the statutory form. The form must be completed in full and contain all of the relevant information requested. Applicants must also serve a notice of their application on each of the Responsible Authorities.

New applications and applications for provisional statements or to vary an existing licence must be advertised and are open to responsible authorities and the public to make representations.
The consultation period for these application types is 28 consecutive days starting on the day on which the application is received by the Licensing Authority. Applicants must display a notice at the premises in a place at which it can be conveniently read by members of the public from the exterior of the premises. The notice must be able to be read when the premises is either open or closed. The notice must be displayed for a period of no less than 28 consecutive days.
