Summary
To hold civil marriages and civil partnerships at your premises you need an approval from Manchester City Council. The approval certificate will show that the premises have been approved for the solemnisation of marriages in pursuance of Section 26(1)(bb) of the Marriage Act 1949 and for the registration of civil partnerships in pursuance of Section 6 (3A)(a) of the Civil Partnership Act 2004.
You must be the proprietor or a trustee of the premises to apply for permission to hold civil ceremonies or weddings.

Validity / Renewals
A Licence is valid for 3 years.
The holder may apply for the renewal of an approval when the current approval has less than twelve months to run. An application for renewal made in this period will extend the current approval until the application has been finally dealt with. A renewal will run from the expiry date of the current approval.

Declaration
Upon completion of your application you will be required to confirm that you:
a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within;
b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law;
c) declare that the information provided is true to the best of your knowledge and belief;
d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution;
e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation;
f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police;

Application Evaluation Process
Your application and plan will be made available to the public for inspection, you are responsible to advertise the application either in a local newspaper or on the local authority's website, as part of a public consultation process.
The advertisement must be placed in a local newspaper (one which is published at least once a week), or on the local authority's website, giving details of the application, with a period of three weeks for objections. For further details see Guidance notes section 1d.
To be granted you application must be in the correct format and your premises deemed suitable.
However your application may still be refused if it is felt that there are too many approved premises in the area for the registrars to attend. Conditions may be imposed to your approval.
The Registrar General may issue guidance to local authorities to assist them in making their decision.

Processing Timescales
The application will only be considered completed once an advertisement has been placed either in a local newspaper or on the local authority's website (see guidance notes section 1d).
The consultation period will be for 21 days and will commence the day after the advert appears in the local newspaper / on the website.
If the application meets all the requirements set out by Manchester City Council and there are no objections, approval will be granted 28 days after the end of the consultation period.
If there are objections the matter has to go before the Licensing & Appeals Committee of the Council, which can take a minimum of two months. If the application has to go to Committee then you will receive further information about the timescales at that time.

Will Tacit Consent Apply
Tacit Consent will apply.
This means that you will be able to act as though your application is granted if you have not heard from Manchester City Council by the end of the target period.
Please note Tacit Consent will only apply once a full application has been submitted and you have received an acknowledgment from Manchester City Council.

You have the right to seek a review of Manchester City Council's refusal to grant your application.
You must deliver your request for review to the proper officer of Manchester City Council, accompanied by any requested fee.

You have the right to seek a review of Manchester City Council's imposition of conditions, refusal to renew or revocation of approval.
You must deliver your request for review to the proper officer of Manchester City Council, accompanied by any requested fee.
If you object to an application for premises approval you must give notice to Manchester City Council within 21 days of the notice of application appearing in the local newspaper.
