Summary
Clubs are organisations where members have joined together for particular social, sporting or political purposes and then combined to buy alcohol in bulk as members of the organisation to supply in the club, or provide regulated entertainment.
They commonly include Labour, Conservative and Liberal Clubs, the Royal British Legion, other ex-services clubs, working men’s clubs, miners welfare institutions, social and sports clubs.
To provide one or more qualifying club activities (i.e. supply of alcohol, regulated entertainment, provision of facilities for music and dancing), the premises must hold a Club Premises Certificate. -

Validity / Renewals
The Certificate is valid whilst the premises is used for licensable activities and subject to annual fees. The City Council will automatically raise an invoice for the payment. -
Relevant legislation
Clubs must be qualifying clubs. A qualifying club has general conditions it must satisfy. These are:
a) a person may not be given memberships or as a candidate for membership to any membership privileges without an interval of at least two days from their membership application or nomination and their membership being granted;
b) that club rules state that those becoming member without nomination or application cannot have membership privileges for at least two days between them becoming members and being admitted to the club;
c) that the club is established and conducted in good faith;
d) that the club has at least 25 members;
e) that alcohol is only supplied to members on the premises on behalf or by the club;
Additional conditions in relation to the supply of alcohol must be complied with. These conditions are:
a) that alcohol purchased for and supplied by the club is done by members of club who are over 18 years of age and are elected to do so by the members
b) that no person at the expense of the club receives any commission, percentage or other similar payment in regard to the purchase of alcohol by the club
c) that there are no arrangements for anyone to receive a financial benefit from supplying alcohol, apart from any benefit to the club or to any person indirectly from the supply giving a gain from running the club.
Registered industrial and provident societies and friendly societies will qualify if the alcohol is purchased for and supplied by the club is done under the control of the members or a committee of members. Relevant miners' welfare institutes can also be considered. A relevant institute is one that is managed by a committee or board that consists of at least two thirds of people appointed or elevated by one or more licensed operators under the Coal Industry Act 1994 and by one or more organisations who represent coal mine employees. The institute can be managed by the committee or board where the board cannot be made up as detailed above but is made up of at least two thirds of members who were employed or are employed in or around coal mines and also by people who were appointed by the Coal Industry Welfare Organisation or by a body who had similar functions under the Miners' Welfare Act 1952. In any case the premises of the institute must be held on a trust as required under the Recreational Charities Act 1958.

Upon completion of your application you will be required to confirm that you:
a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within;
b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law;
c) declare that the information provided is true to the best of your knowledge and belief;
d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution;
e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation;
f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police;

Application Evaluation Process
A club can apply for a club premises certificate for any premises which are occupied and used regularly for club purposes. Applications should be made to Manchester City Council licensing unit.
A club operating schedule is a document which must be in a specific format and which includes information on:
a) the activities of the club;
b) the times the activities are to take place;
c) other opening times;
d) if alcohol supplies are for consumption on or off the premises or both;
e) the steps that the club propose to take to promote the licensing objectives;
f) any other information that is required;

If no relevant representations (i.e. representations that were not deemed frivolous or vexatious) are received against your application, it will be granted as applied for upon completion of the consultation period.
A hearing must be held if any relevant representations are made (and not withdrawn) in respect of the application. If a hearing is held the licence can be granted or granted subject to additional conditions, licensable activities listed in the application can be excluded or the application can be rejected.
Manchester City Council will serve a notice of its decision on the applicant, any person who has made relevant representations and the chief of police.

Processing Timescales
A copy of the application will be provided by the Licensing Unit to the Responsible Authorities by no later than the first working day after the application is received. Please note: this only relates to applications submitted online.
You are required to serve a copy of the application, including the accompanying documentation, to the “responsible authorities” on the same day as the application is given to the Licensing Unit if posting the application.
The consultation period is 28 days from receipt of the application. At the end of the consultation period if no representations have been made the licence will be granted and issued with a further 2 weeks.
If relevant representations are made against the application, a hearing will be held within 20 working days after end of consultation period, where the matter will be decided by the Licensing Sub-Committee.
A decision notice will be sent within 10 working days of the determination.

Will Tacit Consent Apply
Tacit Consent will apply.
This means that you will be able to act as though your application is granted if you have not heard from Manchester City Council by the end of the target period.
Please note Tacit Consent will only apply once a full application has been submitted and you have received an acknowledgment from Manchester City Council.

Applicant Complaints

A failed applicant will receive notice of the refusal of an application for a certificate or variation of a certificate from Manchester City Council Licensing unit.
If an application is rejected, the applicant may appeal the decision.
A licence holder can appeal against a decision to put conditions on a certificate or to exclude any club activity.
Appeals against the decision of a review can be made.
A club may appeal against the withdrawing of a certificate.
Appeals must be made to the local Magistrates' court within 21 days of the decision appealed. -
