  • Summary

    A premises licence is required to authorise the use of a premises for licensable activities.

    This includes the sale or supply of alcohol, regulated entertainment, provision of facilities for music and dancing, and late night refreshment (the provision of hot food or drink between 2300 and 0500 hours).

  • Validity / Renewals

    The Licence is valid whilst the premises is used for licensable activities and subject to annual fees.
  • Relevant legislation

    Any of the following may apply for a premises licence:
    a) anyone who uses carries on a business in the premises to which the application relates;
    b) a recognised club;
    c) a charity;
    d) a health service body;
    e) a person who is registered under the Care Standards Act 2000 in relation to an independent hospital;
    f) a chief police officer of a force in England and Wales;
    g) anyone discharging a statutory or function under Her Majesty's prerogative;
    h) a person from an educational institute;
    i) any other permitted person;

    Applicants must not be under 18 years of age.

  • Declaration

    Upon completion of your application you will be required to confirm that you:
    a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within;
    b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law;
    c) declare that the information provided is true to the best of your knowledge and belief;
    d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution;
    e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation;
    f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police;
  • Application Evaluation Process

    Applications must be submitted to the licensing authority for the area where the premises are located.

    Your application will include an operating schedule, a plan of the premises and a form of consent from the premises supervisor (for applications where the sale of alcohol will be a licensable activity).

    An operating schedule will include details of:
    a) the licensable activities;
    b) the times when the activities will take place;
    c) any other times when the premises will be open to the public;
    d) in the case of applicants who wish to have a limited licence, the period the licence is required for;
    e) information in respect of the premises supervisor;
    f) whether any alcohol that is to be sold is for consumption on or of the premises or both;
    g) the steps proposed to be taken to promote the licensing objectives;
    h) any other required information;

    Applicants are required to advertise their application in accordance with the relevant regulations. You can download a template here, please refer to the guidance notes on how to complete.

    If no relevant representations (i.e. representations that were not deemed frivolous or vexatious) are received against your application, it will be granted as applied for upon completion of the consultation period.

    A hearing must be held if any relevant representations are made (and not withdrawn) in respect of the application. If a hearing is held the licence can be granted or granted subject to additional conditions, licensable activities listed in the application can be excluded or the application can be rejected.

    Manchester City Council will serve a notice of its decision on the applicant, any person who has made relevant representations and the chief of police.
  • Processing Timescales

    A copy of the application will be provided by the Licensing Unit to the Responsible Authorities by no later than the first working day after the application is received. Please note: this only relates to applications submitted online.

    You are required to serve a copy of the application, including the accompanying documentation, to the “responsible authorities” on the same day as the application is given to the Licensing Unit if posting the application.

    The consultation period is 28 days from receipt of the application. At the end of the consultation period if no representations have been made the licence will be granted and issued with a further 2 weeks.

    If relevant representations are made against the application, a hearing will be held within 20 working days after end of consultation period, where the matter will be decided by the Licensing Sub-Committee.

    A decision notice will be sent within 10 working days of the determination.

  • Will Tacit Consent Apply

    Tacit Consent will apply.

    This means that you will be able to act as though your application is granted if you have not heard from Manchester City Council by the end of the target period.

    Please note Tacit Consent will only apply once a full application has been submitted and you have received an acknowledgment from Manchester City Council.
  • Applicant Complaints

    There is a right of appeal against decisions of the Licensing Sub-Committee. Appeals should be made to a Magistrates' court within 21 days of notice of decision.
  • Consumer Complaints

    An interested party or responsible authority may apply to the licensing authority to review the premises licence.

    A hearing will be held by Manchester City Council.
  • Other Complaints

    The chief police officer for the police area where the premises are located can apply to the licensing authority for a review of the licence if the premises are licensed to sell alcohol by retail and a senior officer has given a certificate that they are of the opinion that the premises are associated with either serious crime or disorder or both.

    A hearing will be held and the licence holder and other interested parties may make representations. A chief police officer can give a notice to the licensing authority if they believe that the transfer of a licence to another, under a variation application could undermine crime prevention objectives. Such a notice must be given within 14 days of receiving notification of the application.

    An interested party or responsible body may make representations in relation to a licence application or request the licensing body to review a licence. An interested party or responsible authority may apply to the licensing authority to review the premises licence.

    A hearing will be held by Manchester City Council. A chief police officer may make representations to the licensing authority for a review of the licence if the premises are licensed to sell alcohol by retail and a senior member of the force has given a certificate to state that in their opinion the premises are associated with serious crime, disorder or both.
