Summary
Manchester City Council has adopted Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982 and all street trading within the boundaries of the district is controlled by the Council.
Street trading is not permitted in any of the designated prohibited Streets.
Street trading within the remaining streets is only permitted when a Licence has been issued by the City Council.
Within the City Centre there are several areas where street trading is prohibited, these being:
• New Cathedral Street
• St Ann's Square / Exchange Street
• Exchange Square
• King Street (pedestrian area)
• Market Street
• Piccadilly
• St Mary's Gate
“Street trading” means the selling or exposing or offering for sale of any articles in a street.
A “Street” includes any road, footway, beach, any part of a street or other area to which the public have access without payment.
There are 2 type of Licence issued by Manchester City Council:
1. Street Trader Licence – which includes the City Centre and extends to the Inner City Ring Road.
2. Street Trader Consent – which incorporates the remaining streets within the City of Manchester boundary. Please refer to Street Trader Consent not Street Trader Licence.

Fees
Street Trader Licence £720.00 -
Validity / Renewals
The Licence is valid for 12 months and expires 28 February.
Full fee is paid with initial application with the second year calculated pro-rata.
The Licence is renewed annually. -
Relevant legislation
You must provide specific information, including details of what you want to sell, where you want to trade and days and times you wish to trade.
You must complete with all the conditions attached to the Licence and must be over 17 years of age.
A Licence is granted by the Licensing and Appeals Committee and can be refused for any of the following reasons:
a) there is not sufficient space in the street you wish to trade in, without causing interference or inconvenience to street users;
b) you wish to trade for less days that any minimum required trading days;
c) you are unsuitable to hold a licence due to any previous convictions or for other reasons;
d) you have previously failed to pay fees due under another street trading licence or have failed to use a previous street trading licence.

Declaration
Upon completion of your application you will be required to confirm that you:
a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within
b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law
c) declare that the information provided is true to the best of your knowledge and belief
d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution
e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation
f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police

Application Evaluation Process
If you application is refused you will be served a Notice by the Licensing and Appeals Committee detailing the reasons for their decision and it will state that within 7 days of the notice you can request, in writing, the opportunity to make representations before the Committee. -
Processing Timescales
Applications for a Street Trader Consent can take 8 weeks to process, due to the lengthy consultation period. Where your application receives objections, the application will be forwarded to the Council’s Licensing and Appeals committee for determination.
If you wish to appeal a decision of the Council you must lodge an appeal at Manchester Magistrates’ Court within 21 days of the date you were notified of the decision.

Tacit Consent will not apply due to public safety. -
