Application for a Licence to Let a House in a Selective Licensing Area

Summary
Certain areas of Manchester have been designated as Selective Licensing Areas following approval by the Government.
If you rent out a house in a designated Selective Licensing Area you will require a licence from your local authority.

Fees
Application fee for first application £425 reducing to £317 for subsequent applications if owner has more than one house.
Potential late application fee of £100 if application received late.
Potential additional finder’s fee of £150 if no application has been received and the local authority has to carry out an investigation to locate the house.

Validity / Renewals
Under a Selective Licensing Scheme, a designation can only last for a 5 year period. This means that the maximum length of a licence will be 5 years from the date the designation of the scheme comes into effect.
The dates of the designations became effective are as follows:
a) Harpurhey & Lightbowne area of Moston ward from 3 August 2007 – 2 August 2012;
b) Bradford ward including the areas known as Openshaw and Beswick from 3 August 2007 – 2 August 2012;
c) Gorton North & Gorton South from 2 November 2007 – 1 November 2012;
A Licence will be issued to expire at the end of the designation, in certain circumstances may be issued for a shorter period.

Attachments to be submitted with your Application
a) Criminal Disclosure Certificate;
b) a Responsible Person’s Fit And Proper Declaration form – Form B (if applicable);
c) a Company and Charities form - Form A (if applicable);
d) Periodic Electrical Safety Test Certificate (if carried out);
e) Gas Safety Certificate;
f) Portable Appliance Test Certificate (PAT) (if applicable);
If your house is a House in Multiple Occupation (HMO) that does not meet the criteria for Mandatory HMO licensing but falls in a Selective Licensing area, you are also required to submit the following:
a) Floor plans at 1:50 scale;
b) Fire Alarm Test Certificate;
c) Building Regulations Certificate (if applicable);
d) Evidence of Planning Consent (if applicable);

Declaration
Upon completion of your application you will be required to confirm that you: -
a) have read fully and understood the contents of this form and any supporting information and agree to the terms and/or conditions set out within;
b) understand that by submitting this application, you consent to Manchester City Council passing on the data within this application and its supporting documents to any authority or person that will assist its determination of this application, or as required by law;
c) declare that the information provided is true to the best of your knowledge and belief;
d) understand that if any false information is provided you may be guilty of an offence and liable to prosecution;
e) understand that if the application is authorised you must inform the authority about any changes to circumstances that mean you no longer meet the conditions for the authorisation;
f) understand where a statutory declaration has been provided it may be forwarded to Greater Manchester Police;

Application Evaluation Process
Licences will be granted if:
a) the applicant is a fit and proper person and the most appropriate person to hold the licence;
b) the proposed manager has control of the house, and is a fit and proper person to be the manager;
c) the management arrangements are satisfactory;
d) the house is or can be made suitable for multiple occupation (if applicable);

Processing Timescales
Following receipt of a completed application in respect of:
a) a house not in Multiple Occupation the Council will process the application within 6 weeks;
b) of a house in Multiple Occupation, the property will need to be inspected before an application can be processed and a licence issued;
If during the inspection, Category 1 Hazards are detected in accordance with the Housing, Health and Safety Rating System, no further work will be done on the application until the Category 1 Hazards have been removed to the satisfaction of the Council.
Once the property condition has been judged satisfactory, the Council will process the application within 8 weeks.
