Crime, antisocial behaviour and nuisance Order for Rochdale Canal Undercroft, Piccadilly

Notice of making

Following public consultation we have extended the duration of the Rochdale Canal Undercroft, Piccadilly Public Spaces Protection Order that originally came into effect on 24 April 2017 under the Anti-Social Behaviour, Crime and Policing Act 2014 for a period of three years, with the extension it is in effect until 23 April 2023, at which time it will be reviewed.

The Order is in place to prevent criminal and anti-social activities in the restricted areas - robbery, theft, assault, threats to harm, criminal damage, abusive behaviour, anti-social behaviour including drug taking and drug-related activity, sexual activity, defecation, urination.

The restricted areas

Marked A and B on the Order plan and cover two areas of Rochdale Canal access ramps/towpath/canal landings, including the area known as the Rochdale Canal Undercroft. They are described in the Schedule to this Notice.

The restriction

Members of the public are not allowed to be in the restricted areas at any time between the hours of 10pm and 7am. Barriers will be installed, operated and maintained by us at the places shown on the Order plan. The Order will be in effect for three years, unless it is changed or extended.  Access between 7am and 10pm is not affected.

Exemptions

The Order does not apply to: 

  1. boaters using the towpath for the navigation of boats and barges on the Rochdale Canal
  2. operatives of the Canal and River Trust
  3. any landowners or occupiers of premises adjoining or adjacent to the Restricted Areas requiring access for security purposes or to carry out maintenance or repairs
  4. anyone on Council business including security staff employed by us to manage the Restrictions
  5. any police, ambulance or fire service personnel
  6. any statutory undertaker, gas, electricity, water or communications provider requiring access to their apparatus situated in the restricted areas
  7. any person authorised in writing by us.

Alternative route

Via the footways of Auburn Street, crossing Aytoun Street by the pedestrian crossing, continuing on Auburn Street, crossing the A6 Piccadilly/London Road by the pedestrian crossing, Ducie Street and Dale Street, to the entrance to the towpath at Dale Street Bridge and vice versa (shown on the alternative route plan).

Failure to comply

We may issue a Fixed Penalty Notice of up to £100 or prosecute in the criminal courts, with a fine on conviction of up to £1000.
