The Council and democracy Data protection, personal information and your rights

Ask us to stop using or delete personal information

You have the right to ask the Council to stop using and/or to delete your personal information. This is commonly known as the ‘right to be forgotten’.

In some circumstances you can ask for your personal information to be deleted, for example:

  • where your personal information is no longer needed for the reason it was originally collected
  • where we are relying on your consent, and you have removed your consent for us to use your information
  • where there is no other legal reason for the use of your information
  • where deleting the information is a legal requirement.

Where your personal information has been shared with others, we'll do what we can to make sure that those organisations using your personal information are aware of your request for your information to stop being used or for it to be deleted . If we cannot do this, we will let you know.

Sometimes we can't delete your information, for example where:

  • we're required to have it to comply with a legal obligation
  • it is used for freedom of expression
  • it is in the interest of the wider public, for example public health purposes
  • it is for archiving purposes in the public interest, such as scientific and historical research, or statistical purposes where the information is required
  • it is necessary for legal claims, or
  • where your personal information is needed to comply with a task carried out in the public interest or for our official functions as a council. (e.g. information held in council tax records that we rely on to make decisions about payments).
