Decision
To approve as a correct record, the Minutes of the meeting held on 28 September, 2006.
PH/06/34 Deferrals
The Chair requested approval of the Committee for deferral of application 079735, concerning 62 Beech Road, Chorlton Ward to allow for a site visit.
Decision
To agree to defer the above application for the reason stated.
Decisions taken under Delegated Powers
PH/06/35 Applications for permission for development
Reports of the Head of Planning were submitted in relation to various applications for planning permission. Late representations were also submitted in respect of individual applications, and further late representations were reported at the meeting. The Committee heard representations made by objectors/applicants/local councillors in relation to applications 080520, 078428, 080076, 079995, 080347, 080103, 080264, 080275 and 079453.
Prior to the meeting members of the Committee made a site visit to 167 Yew Tree Road, Fallowfield Ward (079995).
Decision
1. To approve the following applications, in accordance with the reasons put forward by the Head of Planning in his report and any late representations, and subject also to the conditions proposed in his report or in the late representations submitted: 080520: Land forming the Miles Platting Neighbourhood as bounded by New Allen Street, Livesey street, Oldham Road, Sawley Road, Varley Street, James Street, Lwr Vickers Street, Danson Street, Iron Street, Rear of Kenwin Street, Bradford Road and Old Mill Street, Miles Platting and Newton Heath, Ancoats and Clayton and Bradford Wards.*
Full Application for the re-development of the Miles Platting Neighbourhood area, comprising the erection of 11 new dwelling houses (4 on Sawley Road, 2 on Bradford Road and 5 on Chippenham Road (following demolition)), part 2/3 storey extension to Butler Court to provide 20 additional apartments for the elderly, external alterations to 7 existing high rise blocks (Alburn, Nelson, Queensbury, Butler, Landos, Gunson and Naylor Courts), new boundary treatments to all domestic properties, physical upgrading of 1548 houses and apartments, conversion of 22 apartments at Millhead Avenue and Manstead Walk to form 11 family houses, and removal of 65 apartments from existing high rise blocks to form larger residential units, environmental and public realm works including the provision of 6 pocket parks (following demolition); and the carrying out of associated highway improvements throughout the area.

080076: Land bounded by Ashton Old Road, Fairfield Road and Manchester City Boundary, (Toxteth Street Neighbourhood) Bradford Ward*
Outline application for the redevelopment of the Toxteth Street Neighbourhood area, comprising the erection of a maximum of 432 residential dwellings and means of access with the maximum building heights of three storeys. Erection of extension to St. Peters R C High Sports Hall (156 sq.m) and provision of three all weather pitches, multi sport area, associated landscaping and 30 parking spaces. New public open space and public realm works. Provision of new highway network. Erection of a pair of part2/part3 storey semi-detached dwelling houses following the demolition of the existing dwelling house, and Conservation Area Consent for the demolition to facilitate the redevelopment.

Erection of first floor extension at side and conversion into a separate dwelling house and the provision of a parking space for the new dwelling in the rear garden adjacent to the garage of the existing house.
080264: 461/463 Wilmslow Road, Withington Ward*
Change of use of basement and ground floor of former bank to a mixed use comprising restaurant, café and bar (sui generis) including installation of a flue to rear elevation and alterations to the front elevation. (Subject to further conditions relating to (i) no off sales or take-aways being permitted and (ii) the shutters to be raised during the daytime)
080275: O Neills, 655/657 Wilmslow Road, Didsbury East Ward
Variation of condition 2 attached to application 070521 to permit premises to remain open between 8.00am to 12.30am on Sundays to Thursdays and between 8.00am to 1.30 am on Fridays, Saturdays, Christmas Eve, New Years Eve and St. Patrick's Day (17 March)
(Councillors Carmody served as a member of the Licensing Appeals Panel in relation to this application, and left the room and took no part in the consideration of this item).
2. To be Minded to Approve the following application, in accordance with the reasons put forward in his report or any late representations and subject to any conditions proposed in his report or any late representations, and to authorise the Head of Planning to issue an approval notice in once outstanding issues have been resolved to his satisfaction:
080347: 12 Vincent Avenue, Chorlton Ward*
Conversion of house in multiple occupation to create 5 apartments with associated car parking, together with external elevational alterations including a new porch, new windows and enlarged lightwell.
(Subject to further discussions and agreement relating to disabled access)
3. To be Minded to Refuse the following application due to concerns regarding the loss of off street parking and the lack of private amenity space for the occupiers of the property and the Head of Planning to report back to the next meeting as to whether there were relevant planning considerations that could reasonably sustain a decision to be minded to refuse:
079995: 167 Yew Tree Road, Fallowfield Ward*
Erection of part retrospective single storey rear extension to form additional living accommodation and conservatory and conversion of garage into living accommodation including elevational alterations. (Councillors Morrison declared an interest in this application having written in support of the objectors and left the room and took no part in the consideration of this item).
4. To be Minded to Refuse* the following application due to concerns regarding residential amenity and the Head of Planning to report back to the next meeting as to whether there were relevant planning considerations that could reasonably sustain a decision to be minded to refuse:
080292: 311/313 Wilmslow Road, Fallowfield Ward
Variation of condition 4 attached to planning permission 050221 and condition 7 attached to planning permission 056824 to extend opening hours to 11.00am to 2.00am Sunday to Thursday and 11.00am to 02.30am Friday and Saturday with 30 minutes dispersal time.
5. To Refuse* the following application:
Application 078428 For a variation of condition 3 of planning permission 060606 to allow opening from 9.00am to 2.00am seven days a week at 371 Oldham Road, Miles Platting and Newton Heath Ward, on the grounds that the proposal would lead to the potential for a significant increase in general noise and disturbance to local residents by virtue of associated general and vehicular activity at times of rest and reduced background noise, in close proximity to a residential area, to the detriment of the amenity of local residents. The proposal is therefore contrary to policies HC1, HC2.2, DC26.1 and DC26.3 of the Unitary Development Plan for the City of Manchester (adopted 1995).
6. To Refuse* the following application:
Application 079453 For a variation of condition 3 imposed upon planning approval 053251, to allow change of opening hours to 11.00am to midnight, Monday to Thursday and 11.15am to 1.00am Friday and Saturday and 12 noon to midnight on Sundays at the Pitcher and Piano, 1D School Lane, Didsbury East Ward*, on the grounds that the proposed extension of hours to allow the premises to serve until midnight Sunday to Thursdays and 1.00am Fridays and Saturdays will create additional comings and goings late at night and give rise to unacceptable levels of noise disturbance in the area for nearby local residents due to the nature of the use and proposal and is therefore contrary to policies H2.2, DC26.1, DC26.3 DC10.1 and DC10.4 of the Unitary Development Plan for the City of Manchester.
