10. MCC Processes - EHE Unsuitable

10.1 Parents will receive written notification if the LA considers that suitable education is not being provided, specifying the grounds for concern and the reasons which have led to the conclusion.

10.2 The LA will remove the child’s details from the EHE register and place them onto to the Child Missing Education (CME) register within the LA’s database. The LA will then identify suitable education provision as described in 6.10

10.3 An LA officer will contact the parent to discuss school preferences and gather any other relevant details you wish the IYFAP panel to consider when identifying a school place for your child to attend.

10.4 If parents disagree with the LA’s unsuitable decision, they will have the opportunity to address the identified concerns and report back to the LA within an agreed timeframe. See Section 17 below. In order to minimise time out of education, should the original decision be upheld, the process in 10.3 will continue until the outcome of the appeal is known.

10.5 If parents do not take up the offer a suitable school place and the child remains out of education, statutory attendance procedures will be followed, which could lead to a fine or prosecution.

10.6 If EHE is subsequently deemed to be suitable, the child will be moved back to the EHE register and a named officer will maintain contact. See 9.2.
