8. Withdrawal of a Penalty Notice
8.1. There is no statutory right of appeal to the issuing of a penalty notice in relation to education matters.
8.2. The Local Authority will withdraw any Notice issued if one or more of these conditions exist:
- That authority determines that –
- It should not have been issued; or
- It should not have been issued to the person named as the recipient; or
- It appears to the authority that the notice contains material errors.
- Where any of the above occurs, written notice of the withdrawal shall be given to the recipient and any monies paid over shall be fully refunded.
