New application process
The proposed policy introduces a two-stage application process.
This would help us to make decisions that support:
- Sustainable trading.
- Public health.
- Safe and accessible streets.
- High-quality public spaces.
It would also help traders receive clearer decisions more quickly.
Stage 1: Location and access check
Applications would first be checked against safety and access requirements.
A location must:
- Not be in a prohibited area.
- Allow emergency vehicles to access the area.
- Not block visibility for road users.
- Not cause significant disruption to people walking.
- Not block entrances, exits or access points.
Only locations that meet these requirements would move to the next stage.
Stage 2: Assessment and consultation
Applications that pass Stage 1 would be assessed in more detail and considered alongside consultation feedback.
We would look at:
The applicant
- Whether the applicant is suitable to hold a street trading consent.
Contribution to the public realm
- How the proposal adds to the local area.
- Whether it provides a diverse range of goods or services.
- Access to healthier food choices.
- Sustainability.
- Accessibility.
Neighbourhood impact
- Noise and smells.
- Waste management arrangements.
- Proposed trading hours.
Applications may be refused if concerns cannot be addressed through conditions.
Other proposed changes
The draft policy also includes:
- Minimum food hygiene rating requirements.
- Clearer rules about landowner permission.
- Limits on how long mobile traders, such as ice cream vans, can stay in one location.
- Restrictions on selling unhealthy food near schools.
- Removal of identification badges for street trading assistants.
- Updated fees and standard conditions, which would be consulted on separately.
