Model conditions are used to give consistent reference material for all parties involved in the licensing process
We are refreshing the model conditions to ensure they are up to date, represent best practice, as well as remove any outdated and irrelevant conditions.
As part of this review, we are also proposing new conditions in line with the requirements of the “Martyn’s Law” campaign, which Manchester City Council supports to improve safety measures in our licensed premises. These proposed conditions are set out at 1-5 of the set of model conditions.
These model conditions will not all apply in every case and so should not be seen as ‘standard’ conditions to be automatically imposed on licences. In all cases, conditions will need to be tailored as appropriate to the size, type, location and characteristics of – and activities taking place at – the premises concerned.
We are asking for your views on the conditions to understand:
- Will the conditions work in practice and can they be improved
- Any potential barriers or unintended consequences; and
- Whether there are any other conditions we should include or exclude
Your views will be used to inform the Council’s Licensing Committee in confirming the final set of model conditions that will be used in future
Key benefits
The changes will
- simplify and clarify the conditions we use
- improve enforceability and reduce bureaucracy
- ensure licences include appropriate controls that are capable of being met
- avoid duplicating other legal requirements or other duties and responsibilities placed on the employer by other legislation
