Draft Order

The Council of the City of Manchester (‘the Council’) is satisfied on reasonable grounds that the following two conditions are met:

(i) the Activities described in Schedule 1 to this Order (‘the Activities’) are carried on in a public place and are having a detrimental effect on the quality of life of those in the locality; and

(ii) the Activities are persistent and continuing in nature.

In exercise of its powers under sections 59 and 64 of the Anti- social Behaviour, Crime and Policing Act 2014 (‘the Act’) and all other enabling powers, and having had regard to section 72 of the Act, the Council hereby makes the following Order:

The Restriction

1. Except as provided in Article 2 of this Order no person shall be in the Restricted Areas shown by bold black lines on the plan annexed to this Order (‘the Order Plan’) and described in Schedule 2 at any time.

Exceptions

2. Subject to Article 3, the restriction provided by Article 1 of this Order shall not apply to any occupier of premises adjoining or adjacent to the respective Restricted Areas or to any person engaged on Council business, to any police, ambulance or fire service personnel acting in pursuance of statutory powers or duties, to any statutory undertaker, gas, electricity, water or communications provider requiring access to their apparatus situated in the Restricted Areas or to any person authorised in writing by the Council.

Contravention

3. It is an offence for a person without reasonable excuse to contravene the restriction provided by Article 1 of this Order. A person guilty of an offence is liable on summary conviction to a fine not exceeding level 3 on the standard scale.

Alternative Routes

4. The alternative routes for pedestrians when the restriction provided by this Order is in effect are via the adjacent street footways, as shown by blue lines on the map.

Barriers

5. Barriers will be installed, operated and maintained by the Council at the entrances to the Restricted Areas.

Duration

6. The Order shall take effect on XXXX 2020 and has effect for 3 years subject to any variation or extension of the Order.

Citation

7. The Order shall be cited as the City of Manchester (Alleyways between Ilford Street, Ben Street and Bank Street, Clayton) Public Spaces Protection Order
2020.

Schedule 1 - The activities

Burglary, violence and public order offences, criminal damage, fly-tipping, theft of domestic refuse bins, drug-taking and anti-social behaviour including the use of off-road motorbikes, rowdy behaviour, graffiti and use of the alleys as escape routes in connection with such crime and anti-social behaviour.

Schedule 2 - The restricted areas

  1. Highway over the full width running between 30 and 32 Bank Street and continuing between 21 and 23 Midlothian Street (shown as ‘1’ on the map).
  2. Highway over the full width running between 24 and 26 Midlothian Street and continuing between 19 and 21 Heather Street (shown as ‘2’ on the map).
  3. Highway over the full width running between 20 and 22 Heather Street and continuing between 19 and 21 Ben Street (shown as ‘3’ on the map).
  4. Highway over the full width running between 20 and 22 Ben Street and continuing adjacent to 21 Sheldon Street (shown as ‘4’ on the map).
  5. Highway over the full width running adjacent to 61 Ranelagh Street (shown as ‘5’ on the map).
  6. Highway over the full width running adjacent to 62 Ranelagh Street and continuing adjacent to 51 Ilford Street (shown as ‘6’ on the map).
