Markets Market Rights Licence Declaration

I confirm that:

  • I am at least 18 years of age; and
  • I have the authority to make this application on behalf of my organisation; and
  • all of the details provided are correct; and
  • I will not hold a market without consent by way of a Market Rights Licence, and without the permission of the property owner.

I understand that:

  • my submission of this application does not guarantee that permission to hold the market will be granted; and
  • any unlicensed market is unlawful and may be subject to legal action; and
  • a Market Rights Licence is separate from any other licence or permission, and it is my responsibility to obtain all other necessary planning approvals, licences, consents and permissions required for the operation of the market for which separate fees and notice periods may be applicable; and
  • the Council will not be liable for any consequential losses however caused; and
  • I must take reasonable steps to ensure the safety of everyone at the market, and it is my responsibility to ensure that all activities at the market meet current health and safety legislation, that all equipment is safe and fit to use; and
  • I am responsible for keeping a record of the name, address and contact information of anyone renting a space at the market, and that I am required to make these available to Council officers or representatives when asked; and
  • I must ensure that anyone renting a space at the market complies with all statutory and regulatory requirements and have obtained all necessary consents, licences, certificates, authorisations and insurances; and
  • I am responsible for ensuring that all food and drink sellers comply with all food safety and hygiene regulations, and that I must contact the Environmental Health Service at email envh.licensing@manchester.gov.uk or telephone 0161 234 5004 at least 10 days before the market and provide all requested details in respect of all food and drink sellers at the market; and
  • I must ensure that only the commodities detailed in the Market Rights Licence are allowed to be displayed or sold at the market and that this does not include any Things You Cannot Sell, Store or Display; and
  • I must not display posters or signs on lampposts, buildings, railings etc., without permission of the Council; and
  • it is my responsibility to ensure that the market does not cause any nuisance, damage, inconvenience or disturbance to the premises, neighbours, or visitors; and
  • any offer of a Market Rights Licence made by the Council is subject to the Council receiving all requested documents and payments within the required timescale, and it is my responsibility to provide these documents and make these payments; and
  • any Market Rights Licence issued is personal to me and I cannot assign or transfer it to anyone else; and
  • if I falsify any details or fail to comply with the Market Rights Licence or anything detailed in this declaration the Market Rights Licence will be terminated; and
  • other than in the event of breach or non-compliance, to end a Market Rights Licence I must give seven days written notice to the Council and the Council can give seven days written notice to me; and
  • in the event of a breach or non-compliance the Council may give immediate notice to terminate a Market Rights Licence, and this may also affect future applications for a Market Right Licence.

I agree to:

  • comply with the relevant Sunday Trading legislation, where applicable; and
  • indemnify the Council against all losses, claims, demands, actions, proceedings, damages, costs or expenses, or other liability arising in any way from the operation of the market; and
  • effect and maintain throughout all licensed market days public liability insurance providing at least £5 million cover for markets on private premises or £10 million for markets on Council premises and be able to provide evidence of this upon request; and
  • comply with all statutory and regulatory requirements and all reasonable rules and regulations of the Council in relation to the use of the premises and the operation of the market; and
  • provide safety documents like fire risk assessments, event management plans, food safety plans, and alcohol management plans if requested; and
  • comply with the Code of Practice and share this with all sellers as well as the information leaflet ‘How to Stay IP Legal’ (available to download from the Real Deal website); and
  • notify the Council when any of my details change; and
  • provide access to Council officers or representatives to inspect the market at any reasonable time comply with all their reasonable requests; and
  • pay the market rights fee as requested before a market rights licence is issued; and
  • notify the Council within seven days after each market if more trading spaces than the number specified in the licence are occupied on any and every market day and then pay the corresponding licence fee within seven days of request.
